Presumptions
and collision regulations (COLREGS) guide us in determining
fault and damages for collisions at sea. As large as most
waterways seems to be it is sometimes baffling to understand
how two ships can collide into one another--but they do so.
to do:
1.
Read casebook pages 379-402. Again the cases in this chapter
have been extensively edited; they introduce the doctrinal
and conceptual framework that guides us in determining fault
and liability. There are only seven (7) cases in this section
so give particular attention to your understanding of them.
Be sure to take the time to "squib brief" each case
.
2. Go
to Andrea
Doria--Tragedy and Rescue at Sea (http://www.andreadoria.org/)
and spend time reading through the events of this tragedy.
Get and understanding of how this event happened.
3.
Decide whether the SS Stockholm was culpabable in the sinking
of the Andrea Doria or exculpated by the events or the "law
of collision."
